Cheshire Councils fail in legal challenge to PFI cuts

Posted 27 Jul 2011

A Judicial Review claim against the government's decision to withdraw £100m of credits from the household waste PFI in Cheshire has failed. Viridor was named preferred bidder for the contract in November 2010.

Cheshire West & Chester and Cheshire East Councils appealed the decision made by the department for environment, food and rural affairs (DEFRA) in October 2010, stating that a flawed methodology was used to assess the merits of Cheshire's 25-year scheme to dispose of around 180,000 tonnes of waste annually.

Both local authorities also said that ministers’ under-estimated the benefits of the scheme.

Viridor’s waste solution is based on a Mechanical Biological Treatment (MBT) facility to treat non-recyclable waste, at Lostock Gralam.

Symon Grasby, Development Manager at Viridor, said: “Viridor has worked  alongside the Cheshire authorities throughout this process and will continue to do so in order to find a solution to meet the needs of the Cheshire West & Chester and Cheshire East residents.”

Both authorities have applied for permission to appeal the decision.
